Zatami Terms & Conditions

1. Overview

Welcome to Zatami, operated by Zatami (Pty) Ltd.

Zatami is a South African peer-to-peer vehicle bidding marketplace that provides a platform for private vehicle owners to list their vehicles and for registered users to participate in timed bidding events.

By creating an account, listing a vehicle, placing a bid, or otherwise using Zatami, you agree to these Terms & Conditions.

If you do not agree to these terms, please do not use the platform.

2. Eligibility & User Accounts

You must be at least 18 years old and legally capable of entering into binding agreements under South African law.

Zatami is currently intended for users located in South Africa.

You must provide accurate, current, and complete information when creating and using your account.

You are responsible for keeping your account credentials secure and for all activity carried out through your account.

Zatami may require users to verify their email address, mobile number, identity, or other information before allowing access to certain platform features.

3. Vehicle Listings

Sellers are responsible for ensuring that all information provided about their vehicle is accurate, complete, and not misleading.

This includes, where applicable:

  • Vehicle make, model, year, mileage, and specifications;
  • Ownership and authority to sell the vehicle;
  • Service and maintenance history;
  • Known damage, defects, modifications, or mechanical issues;
  • Vehicle documentation; and
  • Photographs, videos, and other information submitted as part of the listing.

Sellers must not knowingly conceal material information that could reasonably affect a buyer's decision to purchase the vehicle.

Zatami may review listings before publication and may reject, suspend, remove, or request changes to a listing where information is incomplete, misleading, unsuitable, or does not meet Zatami's listing requirements.

Where a vehicle has been approved and placed into a bidding event, the seller agrees to honour the outcome of that bidding event and complete the transaction with the winning bidder, subject to these Terms & Conditions and applicable law.

4. Bidding

Bidding is available only to users who have satisfied Zatami's applicable account and verification requirements.

A buyer must have a verified email address and a verified R500 deposit for the specific bidding event before placing bids.

The R500 deposit applies separately to each bidding event and is not automatically transferable to another event.

The first bid must meet or exceed the advertised starting bid.

Each subsequent bid must exceed the current highest valid bid by at least the minimum bidding increment displayed for that vehicle.

A seller may set a confidential reserve price for their vehicle. Where the highest bid does not reach the reserve price, the sale does not conclude automatically: Zatami will contact the seller, who may choose to accept or decline the winning bid.

Each bid submitted through the platform represents a commitment by the bidder to purchase the vehicle at that bid amount if they are the highest valid bidder when the bidding event concludes.

Users must only place bids that they genuinely intend and are able to honour.

5. Winning Bids & Completion of the Sale

When a bidding event ends, the highest valid bid will determine the winning bidder, subject to Zatami's bidding rules and any necessary platform verification.

The winning buyer and seller are expected to proceed in good faith to complete the vehicle transaction at the winning bid amount.

Following a successful bidding event, Zatami may facilitate the exchange of the relevant contact information between the buyer and seller so that they can arrange the inspection, payment, collection, and transfer of the vehicle.

The buyer and seller are responsible for agreeing on the practical arrangements required to complete the transaction.

6. R500 Bidding Deposit

A R500 deposit is required for each bidding event in order for a buyer to participate.

The deposit is associated with the specific bidding event for which it was paid.

The rules governing refunds, cancellations, forfeiture, and any other treatment of the R500 deposit are set out separately in Zatami's Refund & Cancellation Policy.

7. Zatami's Role

Zatami provides the technology and marketplace that allows buyers and sellers to connect and participate in vehicle bidding events.

Zatami is not the owner or seller of the vehicles listed on the platform and does not purchase vehicles from sellers for resale.

Unless expressly stated otherwise, Zatami does not take possession of the vehicle and does not act as the buyer or seller in the underlying vehicle transaction.

The vehicle purchase price is arranged and settled directly between the buyer and seller. Zatami does not hold the vehicle purchase price in escrow.

8. Vehicle Inspection & Buyer Responsibility

Zatami aims to provide buyers with useful information about listed vehicles, including seller-provided photographs, videos, descriptions, and other listing information.

However, online information and media cannot replace a physical inspection of a vehicle.

Buyers are strongly encouraged to inspect the vehicle, verify its documentation and ownership, and satisfy themselves as to its condition before completing payment and taking possession.

A buyer should not rely solely on the information displayed on Zatami when deciding whether to purchase a vehicle.

9. User Conduct

Users must use Zatami honestly and responsibly.

Users must not:

  • Provide false, fraudulent, or materially misleading information;
  • Submit misleading photographs, videos, or vehicle information;
  • Place bids they do not genuinely intend to honour;
  • Manipulate, disrupt, or interfere with bidding;
  • Engage in shill bidding, collusion, or other forms of bidding manipulation;
  • Attempt to improperly influence another user's bidding;
  • List a vehicle without having the legal right or authority to sell it;
  • Use another person's account or allow another person to use their account;
  • Harass, threaten, or misuse another user's personal or contact information; or
  • Attempt to circumvent Zatami's platform rules or security measures.

Zatami may suspend or terminate accounts, remove listings, cancel participation in bidding events, or take other reasonable action where it believes these Terms & Conditions or platform rules have been breached.

10. Zatami's Responsibility & Limitation of Liability

Zatami is committed to providing a trustworthy and transparent marketplace and takes reasonable steps to support accurate listings, user verification, and responsible bidding.

However, Zatami is a platform that connects independent buyers and sellers. We cannot guarantee the condition, quality, history, ownership, legality, or performance of any vehicle listed by a user, nor can we guarantee that every user will fulfil their obligations.

Zatami is not responsible for losses, damage, disputes, delays, misrepresentations, vehicle defects, failed transactions, or other issues arising from the conduct of a buyer or seller or from the underlying vehicle transaction, except to the extent that such liability cannot lawfully be excluded or limited under applicable South African law.

Nothing in these Terms & Conditions is intended to remove or limit any rights or protections that users have under applicable South African law.

Users are therefore encouraged to carefully review vehicle information, conduct appropriate checks and inspections, and communicate clearly with the other party before completing a transaction.

11. Changes to the Platform or These Terms

Zatami may make reasonable changes to the platform, its features, bidding procedures, or these Terms & Conditions from time to time.

Where material changes are made, Zatami may provide notice through the platform or other appropriate means.

Your continued use of Zatami after updated terms become effective constitutes acceptance of the updated Terms & Conditions.

12. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute relating to these Terms & Conditions or the use of the Zatami platform will be subject to the jurisdiction of the South African courts, subject to any rights or remedies available to users under applicable law.
